Professor Solum over at Legal Theory Blog explains why, as I’ve argued before, legal thought is necessarily shallow. What I don’t understand is this: once you’ve recognized the deep intractability of difference, why would you continue to take theory seriously? Why not just admit that what you’re doing is politics, plain and simple?
